By Brazil Stock Guide – Brazil’s electricity regulator Aneel recommended on Tuesday (24) a 30-year renewal of the concession held by Enel Distribuição Ceará, part of Enel SpA (ENEL IM), following a majority vote by its board.
The recommendation now moves to the Ministry of Mines and Energy (MME), which holds the final authority over contract extensions in the power distribution sector. One board member dissented during the vote.
The decision was enabled by a shift in the time window used to assess service quality, a key requirement for contract renewal. Under the previous evaluation period, spanning 2020 to 2024, the company had failed to meet continuity standards for three consecutive years, which would have blocked the extension.
With the vote taking place in 2026, the regulator updated the assessment window to 2021–2025. The adjustment removed one year of non-compliance and included 2025, when the utility met regulatory thresholds. As a result, the sequence of three consecutive failures no longer applied.
In 2025, Enel Ceará achieved compliance with efficiency metrics tied to electricity supply continuity, meeting a core technical condition for renewal.
Contract extensions for Brazil’s distribution utilities are based on two main criteria: service quality and financial health. While the company was already compliant on financial grounds, the revised quality assessment proved decisive.
The utility also submitted an investment and performance plan aimed at improving service reliability, which was approved by the MME, further supporting the regulator’s recommendation.
The renewal process follows guidelines established by a 2024 decree, which introduced stricter requirements, including consumer satisfaction metrics, uniform service standards across concession areas, and mandatory investment plans tied to tariff cycles.
Out of 19 distribution concessions expiring between 2025 and 2031, 18 have now received a positive recommendation for renewal. The only remaining case under review is Enel São Paulo.
Enel Ceará, headquartered in Fortaleza, serves approximately 3.99 million customers and generates annual revenue of about 7.51 billion reais.
